Its purpose is to correct the economic imbalance that the dissolution of a marriage causes for one of the spouses when that spouse is left at a disadvantage compared to the standard of living enjoyed during the marriage. <\/p>\n\n<p class=\"wp-block-paragraph\">In divorce cases involving professionals, executives, and business owners, calculating spousal support presents additional complexities stemming from the variable nature of income, the existence of non-monetary compensation, business interests, and the significant fluctuations in net worth that characterize these situations.<\/p>\n\n<p class=\"wp-block-paragraph\">This article analyzes the legal framework governing compensatory alimony, the calculation criteria applicable to professionals with complex income structures, the specific features of Catalan law, and the procedural strategies for determining or challenging such alimony.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Basis and Nature of the Compensatory Pension<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\"><strong>Article 97 of the Civil Code<\/strong> provides that a spouse who, as a result of the divorce, finds himself or herself in a situation of economic imbalance relative to the other spouse, shall be entitled to compensation, which may consist of a temporary or lifetime alimony payment.<\/p>\n\n<p class=\"wp-block-paragraph\">In Catalonia, <strong>Article 232-5 of the Catalan Civil Code<\/strong> governs <strong>financial compensation for work<\/strong>\u2014a specific concept that applies under the separate property regime and is distinct from, yet complementary to, alimony.<\/p>\n\n<p class=\"wp-block-paragraph\">While alimony seeks to balance the standard of living after divorce, compensation for work compensates one spouse for their dedication to domestic work or to the other spouse\u2019s professional development during the marriage.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Requirements for Eligibility for a Compensatory Pension<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">For a compensatory pension to be granted, the following requirements must be met:<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>1. Each case requires a specific analysis of all the relevant circumstances. <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Fixed-term or lifetime<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">A pension may be established on <strong>a temporary or lifetime basis<\/strong>. The 2023 reform of the Civil Code introduces significant changes in this regard. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Temporary pension: This is <\/strong>granted for a fixed period, long enough for the recipient to re-enter the labor market or adjust to the new situation. It is the preferred option under the reform. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Lifetime pension: <\/strong>This is granted <strong>only <\/strong>when, due to age, illness, lack of qualifications, or a very long marriage, the recipient cannot reasonably re-enter the workforce.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Modification and Termination of the Pension<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Alimony may <strong>be modified or terminated<\/strong> when circumstances change substantially:<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Reasons for termination: death <\/strong>of the recipient, remarriage of the recipient, stable marital cohabitation of the recipient (more uxorio), expiration of the term for temporary pensions, or cessation of the circumstances that gave rise to the pension.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Reasons for modification: a <\/strong>substantial <strong>change <\/strong>in the payer\u2019s income (job loss, significant reduction), a change in the recipient\u2019s circumstances (securing a well-paid job, increase in net worth), or a significant change in other circumstances considered in the initial determination.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Litigation Strategy<\/strong><\/h2>\n\n<h3 class=\"wp-block-heading\"><strong>For the pension applicant<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">Thoroughly document the standard of living during the marriage using bank statements, receipts, and witness statements. Demonstrate dedication to the home and family with specific details regarding tasks and time spent. Prove the difficulty of re-entering the workforce due to age, qualifications, or the duration of the marriage.
